1. General

These Terms and Conditions apply to all quotations, services, agreements, and deliveries provided by Eray Studio, located in the Netherlands, Schröderstraat 4, Hellevoetsluis. Any deviations are only valid if agreed upon in writing.

2. Services

Eray Studio provides creative services such as branding, visual content, social media visuals, AI-assisted content creation, photography, video, and strategic consulting.
An agreement is established once both parties have confirmed the assignment in writing or digitally.

Delivery of digital files or visuals is considered complete once they have been sent via email, download link, or cloud transfer.

3. Quotes and Pricing

All quotations are non-binding and valid for 14 days unless stated otherwise.
All prices are exclusive of VAT unless indicated.
Eray Studio reserves the right to adjust prices in the event of changes to the assignment or external costs.

4. Payment

Invoices must be paid within 14 days of the invoice date. If payment is not received on time, Eray Studio has the right to suspend work and charge statutory interest and collection costs.

 

5. Liability

Eray Studio is not liable for any indirect damage, such as consequential loss, loss of profit, or data loss.
Liability is limited to the total amount invoiced for the specific project.

6. Rights and Ownership

All delivered concepts, designs, visuals, and other creative works remain the property of Eray Studio until full payment has been received.
After payment, the client obtains a non-exclusive right of use unless otherwise agreed in writing.

This right of use applies solely to the agreed purpose. Reuse, modification, or resale of any creation is not permitted without prior written consent from Eray Studio.

7. Cancellation, Changes and Refunds

Cancellation of an assignment must be made in writing. If cancellation occurs after the start of the work, the client is liable for all hours worked and costs incurred.

Business clients (B2B) are not entitled to refunds or any right of withdrawal. An ongoing assignment can only be terminated by mutual agreement, in which case Eray Studio is authorized to invoice the full project amount.

Private clients (B2C) are entitled to a refund only if the execution of the service has not yet begun. Once Eray Studio starts the work with the client’s consent, this right expires.

 

If more than fifty percent of the work has been completed, Eray Studio is entitled to invoice the full project fee.
Deposits are non-refundable.
Changes to the assignment may result in adjusted planning or additional costs.

8. Confidentiality

Both parties are obliged to keep confidential any information obtained during the course of the collaboration.

9. Complaints

Complaints regarding delivered services must be submitted in writing within seven days of delivery.
Eray Studio will review the complaint and provide a reasonable solution within a reasonable timeframe.

10. Applicable Law

All agreements are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
 

11. Return Policy for Digital Products
Digital products are excluded from the right of withdrawal. Once purchased, returns or refunds are not possible, as the product is delivered instantly and we cannot verify whether the file has been removed from your device.

12. Portfolio Use and Credits

Eray Studio may display completed work and client names in its portfolio, website, and social media channels.
If the client does not consent to this, this must be agreed upon in writing prior to the project.
